All prices are quoted in euros (EUR), including local VAT.
The invoice amount is payable immediately on receipt of the goods, without any deductions. Until payment is made in full, all goods remain the property of the seller (§ 455 BGB).
Postage and Packing
Postage and Packing are charged at EUR 2 per item.
Delivery within Germany is free for orders exceeding EUR 24.90.
For deliveries outside Germany or other special requests, shipping and handling is charged at cost.

Comenius-Institut General Terms and Conditions
as of 1 October 2004
§ 1 Applicability
Any purchase contract between the Comenius-Institut and the buyer are subject solely to the following Terms and Conditions in the form valid at the time of placing the order. Purchasers may not modify any stipulations. The Terms and Conditions are made available to customers on the bookshop page through the link "Terms and Conditions".
§ 2 Conclusion of Contract
I. On placement of an order through the Comenius-Institut's online bookshop at www.comenius.de, the receipt of the order and its details will be confirmed via e-mail.
II. The Comenius-Institut reserves the right to carry out credit assessments of its customers even after despatch of the goods and to cancel contracts in the event their solvency is in question.
III. Should any goods be unavailable, the Comenius-Institut reserves the right to cancel part or all of the contract. The buyer will be informed immediately.
§ 3 Cancellation
The buyer may cancel an order for any reason within two weeks from receipt of goods by notifying the Comenius-Institut by letter, fax, or by returning the goods. Any notification mailed to the address given on the webpage within the period stated shall be considered valid.
§ 4 Delivery
Unless otherwise stipulated, delivery will be made to the address stated by the buyer. Stated delivery times are estimates and without obligation. The Comenius-Institut will make every effort to deliver within the time stated, but can accept no liability for any delays.
§ 5 Delays in Payment
In the event of non-payment of invoices, the Comenius-Institut reserves the legal right to claim interest on any outstanding amounts at a rate of 5 % above the ECB base rate p.a. If the Comenius-Institut should have suffered losses exceeding the amount of the interest from this delay in payment, it also reserves the right to claim further damages. Administrative fees are charged for reminders.
§ 6 Offsetting Claims/Withholding Payment
The buyer shall only be permitted to offset claims against the Comenius-Institut against its invoices, reduce the invoice amount or cancel the contract on the basis of claims established in court or recognised by the Comenius-Institut. The buyer may only withhold payment on an invoice based on claims arising from the same transaction.
§ 7 Conditional Sale
All goods delivered remain the property of the Comenius-Institut until payment has been received in full.
§ 8 Liability for Defects
In the event any goods supplied should be shown to be defective and the defect within the responsivbility of the Comenius-Institut, the Comenius-Institut will undertake to repair or replace the defective goods within an appropriate period of time.
The Comenius-Institut assumes no liability for damage except to the defective goods themselves. It especially assumes no liability for any loss of profit or other monetary loss to the buyer arising from delivery of defective goods. The legal exclusion and/or limitation of liability by the Comenius-Institut also extends to its employees, representatives or agents personally.
The abovementioned liability limitation is invalid in the event of damage caused intentionally or through gross negligence, or in the event of personal injury. It further does not apply in the event of claims made under §§ 1, 4 of German product liability law (Produkthaftungsgesetz).
Should the Comenius-Institut materially breach a sales contract through negligence, its liability for monetary loss is limited to the damage typically expected in such cases. This is usually limited to damage to the goods themselves and does not exceed their purchase price.
§ 9 Privacy
Detailed information on the type, extent, location and purpose of data collected, used and stored in the course of carrying out a sales contract is provided in the privacy statement (Datenschutzerklaerung).
§ 10 Jurisdiction
The contract of sale is governed by German law, excluding CISG.
In the event that parts of the Terms and Conditions should be found not valid, the remainder of the Terms and Condiotions remain in force.
Place of fulfilment and jurisdiction is Muenster.
